    3. AML/CTF Obligations

For the purposes of this clause, ‘you’ and the ‘Client’ is any party engaging with Sharp Property Buyers. The Client acknowledges that Sharp Property Buyers may be subject to obligations under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth), associated rules, regulations and regulatory requirements, as amended from time to time (AML/CTF Laws). Where you engage with Sharp Property Buyers and when requested by them, you must promptly provide all information, records and documents reasonably requested to enable Sharp Property Buyers to comply with AML/CTF Laws and Sharp Property Buyers AML/CTF program, including information required to identify and verify:

    • The Client;
    • any beneficial owner or controller of the Client;
    • any person acting on behalf of the Client; and
    • the source of funds, source of wealth, and purpose of the transaction where reasonably required.

31. If the Client is a company, trustee, partnership, incorporated association, foreign entity or other non-individual, the Client must provide full details of its legal structure, officeholders, trustees, partners, beneficial owners, controllers and any person on whose behalf it is acting to Sharp Property Buyers.
3.2 The Client warrants that all information and documents provided to Sharp Property Buyers are true, correct, complete and not misleading, and undertakes to notify Sharp Property Buyers promptly of any change.
3.3 If a person signs this Engagement or gives instructions on behalf of the Client, that person warrants that they are duly authorised, and Sharp Property Buyers may require evidence of authority before acting on any instruction.
3.4 Sharp Property Buyers may collect, use, verify and disclose information relating to the Client for AML/CTF compliance purposes to any related body corporate, professional adviser, identity verification provider, other participant in the transaction, financial institution, or government, regulatory or law enforcement authority, where permitted or required by law. You acknowledge, agree and consent to such disclosures necessary for Sharp Property Buyer’s compliance of its obligations under the AMF/CTF laws.
3.5 Sharp Property Buyers may rely on due diligence undertaken by another reporting entity and / or may share due diligence information with another reporting entity involved in the transaction where permitted by law.
3.6 Sharp Property Buyers may delay, refuse, suspend or cease acting, or decline to process any instruction or transaction step, if Sharp Property Buyers reasonably considers that doing so is necessary or prudent to comply with AML/CTF Laws, Sharp Property Buyer’s AML/CTF program or any lawful requirement of a regulator or authority.
3.7 Sharp Property Buyers is not liable for any loss, delay, cost or consequence arising from action taken or not taken in good faith for AML/CTF compliance purposes, except to the extent caused by Sharp Property Buyer’s fraud, willful misconduct or breach of law.
3.8 The Client acknowledges that Sharp Property Buyers may be restricted by law from disclosing the reason for any delay, refusal, suspension, report or other compliance action taken in connection with AML/CTF Laws.

Sharp Property Buyers may collect, use and disclose personal information for purposes including:

  • providing buyers agency and related services;
    • identifying and verifying clients (including in compliance with clause 3 for AML / CTF compliance);
    • managing inspections and property enquiries;
    • negotiating property purchases;
    • communicating with clients and prospective clients;
    • sending market updates, newsletters and educational content;
    • improving our services and website functionality;
    • maintaining records and CRM systems;
    • complying with legal and regulatory obligations;
    • complying with AML/CTF obligations; and
